1. Information We Collect

Information you provide: your name, email address, phone number, shipping or billing address, account login details, research affiliation and research-use and age attestations, order requests and order history, messages you send through our contact form or by email, and your email marketing preference.

Payment information: payment is made by Zelle or cash as arranged with a representative. We keep a record that payment was received and the amount and reference, but we do not collect or store card numbers or bank login credentials through the Site.

Information collected automatically: when you visit the Site, our hosting provider and the Site may automatically record technical information such as IP address, browser and device type, pages viewed, referring pages, and date and time of access. The Site also uses browser local storage and similar technologies, for example to remember that you passed the entry age gate, keep your cart and keep you signed in.

2. How We Use Information

We use information to: review, confirm, fulfill and deliver order requests and arrange local pickup; verify age, eligibility and research-use attestations; send order confirmations, payment instructions and service emails; respond to questions and support requests; send marketing emails if you opted in; maintain records required for business, tax, legal and compliance purposes; prevent fraud and misuse and protect the security of the Site; and operate, maintain and improve the Site.

3. How We Share Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only with service providers that help us run our business, and only as needed for them to perform services for us:

• Base44, which hosts the Site and stores Site and account data;
• Resend, which delivers our transactional and marketing emails (including messages from orders@elev8health.net);
• shipping carriers, such as the U.S. Postal Service, to deliver your order;
• professional advisers, such as accountants and attorneys, under a duty of confidentiality.

We may also disclose information if the law requires it, to respond to lawful requests, to enforce our Terms of Sale and Use, to protect the rights, property or safety of Elev8 or others, or in connection with a sale, merger or reorganization of our business.

4. Email Communications

Transactional emails about your orders are part of our service. If you opted in to marketing emails, you can unsubscribe at any time with the unsubscribe link in any marketing email or by emailing sales@elev8health.net. Unsubscribing from marketing does not stop order-related emails.

5. Data Retention

We keep order, payment and attestation records for as long as needed to fulfill orders and to meet our legal, tax, accounting and compliance obligations, generally up to seven (7) years after the order. We keep account information while your account is active. We keep contact-form messages and marketing preferences for as long as reasonably needed to respond and to honor your choices. After that, we delete information or de-identify it.

6. Data Security

We use reasonable administrative, technical and physical safeguards, including the security measures of our hosting and email providers, to protect your information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Your Rights and Choices

You may ask us to access, correct or delete the personal information we hold about you, or to stop sending you marketing emails, by emailing sales@elev8health.net. Depending on your state of residence, you may have additional rights under applicable law, such as the right to know what we collect, to request a copy, to request deletion and to not be discriminated against for exercising your rights. We will verify your request and respond within the time required by law. We may keep certain information where the law requires it or to complete a transaction, prevent fraud or resolve disputes. You can clear local storage and cookies in your browser settings, but some Site features may not work without them.

8. Age Restriction

The Site and our products are intended only for persons 21 years of age or older. We do not knowingly collect personal information from anyone under 21. If you believe a minor has given us information, contact us and we will delete it.

9. U.S. Operations

Elev8 operates in the United States, and your information is processed and stored in the United States.

10. Changes to This Policy

We may update this Privacy Policy from time to time by posting the revised version on this page with a new effective date.
